1. Acceptance of Terms

By accessing or using the Separately website and service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

Separately ("we", "us", "our") reserves the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.

2. Description of Service

Separately provides an online tool that generates estimates of asset division outcomes for Australian users going through separation or divorce. The Service uses the financial and relationship information you provide to produce reports with estimated asset splits, contribution analysis, and related insights.

3. Not Legal Advice

The Service does not provide legal, financial, or tax advice. All reports, estimates, calculations, and insights generated by Separately are for informational and educational purposes only.

The outputs of this Service are estimates based on the information you provide and general principles. They do not account for the full complexity of individual circumstances, judicial discretion, or changes in law. Actual outcomes in family law matters may differ significantly from our estimates.

You should always seek independent legal advice from a qualified Australian family lawyer before making decisions about your separation or divorce.

4. Eligibility

  • You must be at least 18 years of age to use the Service
  • You must be located in or have a connection to Australia for the estimates to be relevant
  • You must provide accurate and truthful information

5. Account Registration

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised use

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Payments and Refunds

6.1 Pricing

Pricing for reports and services is displayed on our pricing page. All prices are in Australian Dollars (AUD) and include GST where applicable.

6.2 Payment Processing

Payments are processed securely by Stripe. We do not store your credit card details. By making a payment, you agree to Stripe's terms of service.

6.3 Refund Policy

Because reports are generated digitally and delivered immediately, refunds are generally not available once a report has been generated. However, we may offer refunds at our discretion in the following circumstances:

  • Technical errors that prevented report delivery
  • Duplicate payments
  • Service was materially different from what was described

To request a refund, contact us within 14 days of purchase at the details in Section 15.

7. Accuracy of Information

The quality and accuracy of your report depends entirely on the information you provide. You acknowledge that:

  • Inaccurate, incomplete, or misleading input will produce unreliable estimates
  • We do not independently verify the information you enter
  • Asset valuations, superannuation balances, and other figures should be based on current and accurate records

8. Intellectual Property

All content, design, code, algorithms, and branding of the Service are owned by Separately and protected by Australian and international intellectual property laws.

You retain ownership of the data you input. Reports generated for you are licensed for your personal, non-commercial use only. You may not redistribute, resell, or publish reports without our written consent.

9. Prohibited Use

You must not:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the Service
  • Scrape, crawl, or use automated tools to access the Service without permission
  • Submit false or misleading information with intent to deceive
  • Use the Service to harass, stalk, or harm another person
  • Resell or commercially exploit the Service or its outputs

10. Limitation of Liability

To the maximum extent permitted by Australian law, including the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010):

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not warrant that the estimates or reports will be accurate, complete, or suitable for any particular purpose
  • We are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Service, including but not limited to financial losses from reliance on our estimates
  • Our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits consumer guarantees under the Australian Consumer Law that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Separately and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Termination

You may close your account at any time from your account settings page. We may suspend or terminate your account if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy, subject to any legal retention obligations.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Australia. Any disputes arising from or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Australia.
